The latest on Bill 102

We have learned that a first draft of the Regulations concerning the application of Bill 102 (The Act to amend the Supplemental Pension Plans Act and other legislative provisions) has been written by the Régie des rentes du Québec (RRQ).

The Regulations will be published in the "Gazette officielle du Québec" at the beginning of August. A period of 45 days will then be allotted to interested parties to make comments.

Following the expiration of the 45 day period¸ the RRQ will review the comments received and¸ if necessary¸ amend the Regulations. The final Regulations should be approved by the end of 2001¸ and would be put in force January 1¸ 2002.

Finally¸ the RRQ anticipates issuing other draft regulations pertaining to specific aspects of the application of Bill 102¸ namely with respect to the following topics:

  • Pension plans exempted from the application of Bill 102
  • Transfers between pension plans of the same employer; and
  • The arbitration process relating to the use of the surplus following the termination of a pension plan.
